1. Qualifying Persons
1.1 Yiannimize Competitions (‘YC’, 'Promoter', 'our(s)') operate competitions – skilled prize competitions resulting in the allocation of prizes in accordance with these Terms and Conditions on the website www.yiannimizecomps.com (the 'Website') - (the 'Competition(s)').
1.2 The Competitions are open to all persons aged 18 and over and the age of majority in their country of residence excluding the Promoter's employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our Competitions.
1.3 The promoter reserves the right at their own discretion to close a Customer’s account or the right to refuse a Customer’s entry to a competition any at time, if they feel the Customer is exploiting the services or they believe that it is not genuinely the Customer that is entering.
2. Legal Undertaking
2.1 By entering a Competition the entrant ('Entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.
2.2 These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
2.3 In the event that you participate in a Competition online via the Website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.
2.4 Apple is not the sponsor nor connected in any way, shape or form witht he competiton.
3. Competition Entry
3.1 These Competitions may be entered online via the Website and App. Multiple Competitions may be open at the same time by the Promoter of which each Competition will have specific prizes.
3.2 Availability and pricing of Competitions and tickets is at the discretion of the Promoter and will be specified on the Website.
3.3 Each competition has a free entry route available meaning that the Competitions do not require a Gamble license to operate (Gambling Act 2005)
4. "Your YC Account(s)
4.1In order to enter a Competition, you will need to register an account with us. You can register an account online at www.yiannimizecomps.com
4.2 To register an account online you will be asked to provide an email address or sign in via Google
4.3 Please note that your email address or Social Media Account will also be the username that you use to login to your account. Each account can only have one username attributed to it at any given time ("YC Account"). Therefore, you cannot attribute multiple email addresses, or Social Media Accounts to your YC Account. For example:
4.3.1You cannot have an email address and a Social Media Account attributed to your YC Account.
4.3.2 You cannot have two or more email addresses attributed to your YC Account.
You can, however, change your username for your YC Account by logging into your YC Account. For example, you can create your YC Account using one email address and at a later date change your username for your YC Account to another email address. However, if you create multiple accounts using different email addresses or Social Media Accounts, each username will be treated as a separate YC Account.
4.4 When playing a Competition online via the Website, follow the on-screen instructions to:
4.4.1 select the Competition(s) you wish to enter and play the Competition (s)
4.4.2 and when you are ready to purchase your Ticket(s), note that the volume of tickets you can purchase is unlimited, provide your contact and payment details. You will need to check your details carefully.
4.4.3 once your payment has cleared we will email you to confirm your entry into the Competition. Please note that when entering online you will not be deemed entered into the Competition until we confirm your Ticket(s) order back to you by email.
4.5 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these Terms and Conditions.
4.6 To the extent permitted by applicable law, all Entries become our property and will not be returned.
5. The “Y Club”
5.1 A Y Club subscription costs the amount set out on the Website this may change from time to time at the Promoters discretion, and if you would like to purchase a Y Club subscription, you can do so through the Website.
5.2 If your Y Club subscription should be cancelled for any reason your new subscription cost will be decided by Yiannimize Competition at their discretion.
6. The “Y Club” requirements
6.1 The Promoter reserves the right to refuse a registration for any reason whatsoever at its sole and absolute discretion (including, without limitation, a person applying to become an Y Club member not satisfying the requirements set out in rule 6.2 below).
6.2 A person applying to become a Y Club member must satisfy the following requirements:
6.2.1 the person’s direct debit must come from an authorised bank,
6.2.2 the person must be 18 or over;
6.2.3 must supply their debit card details which must be linked to a bank account (or building society) for which they are an authorised user and must also be linked their home address. This bank or building society account must not be a joint account and must be held in the applicant’s own name;
6.2.4 the bank (or building society) card referred to in (c) above must not have been reported as lost or stolen and cannot be used to open any more than one Y Club member account; and
6.2.5 the bank (or building society) card referred to in (c) above must bear the applicant’s name and match the applicant’s details supplied including (without limitation) the applicant’s billing address etc.
6.3 By signing up for a Y Club subscription, you hereby authorise the Promoter to collect payment of the subscription fee from your nominated bank account (or building society) until this authorisation is revoked. Subscription payments will be taken from the nominated bank (or building society) account on a monthly basis. Collected payments from your nominated bank (or building society) account entitle you to enter into the applicable upcoming monthly draws following the collected payment.
6.4 When signing up for a Y Club subscription, you will need to provide the Promoter with valid payment details including, where appropriate, your instruction to a nominated bank (or building society) to pay the subscription fee by direct debit. The Direct Debit Guarantee applies to all Direct Debit arrangements set up by you. You can cancel your subscription by visiting “Your Account” section on the website.
6.5 You must keep the information and details (including, without limitation payment details) you provide to us current and up to date throughout the duration of your Y Club membership.
7. Y Club Payments
7.1 At the point of sign up, you will be informed when the first payment of the subscription fee will be taken, which may be immediately. Thereafter, the first attempt to obtain payment each month will be on the date you signed up, unless otherwise communicated to you by the Promoter.
It is your responsibility to ensure that there are sufficient funds in your nominated bank account (or building society) on the applicable date. If there are insufficient funds, your nominated bank (or building society) may impose a penalty charge for the collection and the Promoter may be unable to collect payment and you will not be able to enter into applicable upcoming monthly draws.
The Promoter is not responsible for additional transaction charges imposed on you from your nominated bank (or building society).
7.2 The Promoter accepts no responsibility and will have no liability for any act or omission of any bank (or building society) chargebacks, disputes, indemnities and/or failures to implement direct debits or otherwise to act on your instructions.
7.3 If the Promoter is unable to collect your payment on the applicable collection date you will not be entered into a month’s draw(s) unless the Promoter has received all amounts payable for the subscription in cleared funds for that month.
The Promoter accepts no responsibility and will have no liability for any loss and/or damage caused as a result of you not being entered into a month’s draws in circumstances where the Promoter has sought payment from your nominated bank (or building society) account and the nominated bank (or building society) did not make payment.
7.4 Any change to the details provided to the Promoter during registration should be made under the “Your Account” section of the website. If you wish to change the nominated bank (or building society) specified in your registration, you will need to complete a new direct debit instruction.
7.5 You can terminate your subscription at any time by visiting “Your Account” section of the website and providing 30 days’ notice. The Promoter reserves the right to terminate or suspend a monthly subscription at any time and for any reason whatsoever at its sole and absolute discretion (although this will not affect the results of any monthly draws that you have been entered into).
7.6 With effect from receipt of notice of termination, the Promoter will make one further payment request to your nominated bank (or building society).
8. Refer a Friend Programme
8.1 The Refer a Friend Programme is operated in good faith to reward customers for referring genuine friends and acquaintances as new customers to the Promoter. Referrals are limited to 100 per customer per day. Abuse of this system will not be tolerated and if the Promoter has reasonable grounds to believe that new users are not genuine individuals it reserves the right at its sole discretion to void any orders and/or Y-Club Credit earned as a result of the scheme, and to disqualify such individual as a Prize Winner.
8.2 The referee must be a Y-Club member and they will receive their £10 credit for each successful referral 7 days after the referred joins and does not cancel their membership.
8.3 The referred will receive their additional £10 credit after their second payment is taken.
8.4 The same person cannot be referred more than once.
9. Promotion Periods
9.1 Each Competition will run for a specified period. Please see each Competition for details of start and end times and dates ('Promotion Period(s)').
10.Where's the Ball
10.1 How to enter
10.1.1 The competition will run from and including the opening and closing dates specified on the website. These dates shall be referred to as the “opening date” &/or the “closing date” of a competition.
10.1.2 If it is necessary to do so, the promotor reserves the right to change the opening & closing dates. If the promoter does change the opening date &/or the closing date of a competition, the new details will be displayed on the yiannimizecomps.com website.
10.1.3 All competition entries must be received by the Promoter by no later than the specified time on the closing date, this includes all postal entries. All entries received after the specified time on the closing date are automatically disqualified.
10.1.4 The maximum number entries to the competition will be stated on the website. The number of entries you can make may be limited if the maximum number of entries is reached.

11. “READY SET PLAY COMPETITION”
11.1 How to enter;
11.1.1 The competition will run from and including the opening and closing dates specified on the website. These dates shall be referred to as the “opening date” &/or the “closing date” of a competition.

11.2 How to enter READY SET PLAY

- Select which “Ready Set Play” Competition you wish to enter
- Answer the skill-based question
- Add your selected number of tickets to your basket
- Checkout
- Find your ticket/s under the “My Account” section on the website
11.3 All tickets purchased for “Ready Set Win” can be found under “my tickets” on the website.
11.3.1 To enter for free you must first create an account and then send your name, address, date of birth, e-mail address, contact phone number and write your answer to the skill based question on a postcard to the promoter. Please see T & C 18.4 for further infomation
11.4 The promoter will not accept responsibility for competition entries that are not successfully completed, are lost, or delayed regardless of cause, including, for example, because of any equipment failure, technical malfunction, systems, satellite, network server, computer hardware or software failure of any kind.
11.5 By purchasing entries and submitting a competition entry, you are entering into a contract with the promoter and are agreeing to be bound by these terms and conditions.
11.6 READY SET PLAY WINNER
11.6.1 All entrants who correctly answer the competition question will be places into a draw and the winner will be chosen by random draw. The random draw will take place as soon as reasonably possible and, in any event, within 14 days of the Closing date (Draw date)
12. Competition Judgement
12.1 Where's The Ball: The position of the centre of the Ball will be determined after the close of the Competition by an independent Panel of Judges within a reasonable time (experts appointed by the Promoter – the 'Judge') using their experience and in the presence of a qualified lawyer and a representative from the Promoter ('Judge's Position').
12.212.1 Where's The Ball, the Judge's Position will be computed against the database of coordinates to mathematically calculate which of the valid and eligible Entries received by the Promoter is closest to the Judge's Position, and therefore the winning Entrant (the 'First Prize Winner') of the prize. The First Prize Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the Judge's Position. Please note that there are 2 Runners Up in Where's The Ball Competitions. For the avoidance of doubt, distance will be measured by calculating the straight-line distance from each valid and eligible Entry to the Judge's Position ('Distance').
12.3 12.1 Where's The Ball: In the event that there are two or more Entrants with valid and eligible Entries that are equally close to or exactly match the Judge's Position (each a 'Tie Break Entry'), the entrants to whom such Tie Break Entries belong, identified by their YC Account (the 'Tie Break Entrants') will participate in a tie break mechanic to determine the First Prize Winner for such Competition as follows:
12.3.1 Tie Break Scenario- In the event that multiple entries or entrants match the winning coordinates then each entry will be subject to entering phase 2. Phase 2 is where all entries that have entered phase 2 are represented within the lottery ball machine where an overall winner will be determined by the first automatic selection.
12.4 The Promoter will attempt to contact Winner(s) using the telephone numbers and email address provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant's sole responsibility to check and update these details. If for any reason they are taken down incorrectly, the Promoter will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.
12.5 If for any reason the Promoter is unable to contact a Winner within 5 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these Terms and Conditions, the Winner will forfeit the prize and it will be awarded to the Entrant with the next closest coordinates or the first runner up from the Tie Break scenario. For the avoidance of doubt once the prize has been forfeited the original Winner will have no further claims against the Promoter.
12.6 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants YC Credit to enable them to replay equivalent tickets in a subsequent competition.
12.7 All Entrants are automatically entered onto the Promoter's database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.
12.8 The Promoter reserves the right to cancel any Competition at any time either before or after Entries have been sold. If a Competition is so cancelled, the Promoter will notify each Entrant at the email address they have provided and return any payment made by an Entrant by the same method as payment was made or provide them with a game credit if they so elect to enable them to replay equivalent Tickets in a subsequent Competition. Where a payment has been refunded, the Promoter will have no further liability to the Entrant or to any other person.
13. Winner's Details
13.1 The Winners will be required to send a copy of their passport, driving license or photographic ID to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner being disqualified and the Promoter choosing an alternate winner.
13.2 All Prize Winners are required to provide photographs and/or pose for photographs and videos and have their personal details (including details of any Prize won by them) included in marketing material and public relations by the Promoter in connection with the Competition and in identifying them as a Prize Winner of a Competition. Any failure to meet this requirement may result in the Prize Winner being disqualified and the Promoter re-allocating the Prize.
13.3 Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the prize.
13.4 Surprise Contact Details: On your account page you have the option to add the contact details of an individual who we can contact to help arrange with the surprise if you are a Winner. We will categorically not share or pass these details on to any third party but in adding them you are confirming that you have the consent from the person to pass these details to YC.
14. Competition Prizes
14.1 Competitions: The Competitions are comprised of many different prizes. For the avoidance of doubt, there will be only one prize awarded for each Competition ('First Prize') and not one per model of prize listed. Please also note the following:
14.1.1 During the course of a Competition, if due to circumstances beyond the Promoter's control, the Promoter is unable to provide the stated First Prize, the Promoter reserves the right to award a selection of substitute Left and Right Hand Drive cars of equal or greater value.
14.1.2 If the First Prize Winner would like to take a car, the car will be delivered or available for collection within 7 days. All cars whether left or right hand drive will ordinarily be ordered in the UK from UK dealers. Bespoke options and upgrades can be added at the First Prize Winner's request but must be paid for by the First Prize Winner in advance. The country where the ticket is purchased will determine whether the car will be Left or Right Hand Drive (subject to manufacturer availability and Terms and Conditions).
14.1.3 In the UK the First Prize will be delivered with UK VAT paid. In the EU the First Prize will be delivered with UK VAT paid but any further costs (additional VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the First Prize Winner.
14.1.4 To the extent permitted by applicable law, all Entries become our property and will not be returned.
14.2 All attempts will be made to contact the winner via email and phone. If we are unable to reach the winner or the prize is not collected/delivered within 30 days of the draw date then the winner forfeits the prize.
In all other countries the First Prize will be shipped (net of all taxes) to the nearest port and any applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country will be the responsibility of the First Prize Winner. The promoter reserves the right not to deliver to certain countries. Please note that all our cars are supplied in the UK and therefore if exported may not be road legal in the destination country. It is the First Prize Winner's responsibility to check this and choose an alternative car or take the cash alternative if appropriate.
For the avoidance of doubt, the maximum value that The promoter will be liable to pay for or towards any prize is the UK RRP (or local currency equivalent) of the prize as advertised on our website. YC will only transact with manufacturer recommended principal dealers.
14.1.4 Competition Cash Alternative: Should a Competition Winner not wish to take delivery of one of the First Prizes (including cars or other items listed), the Cash Alternative can be claimed. The Cash Alternative is only available if listed on the prize on the website deemed & published by the promotor at their discretion.
15. Storage
15.1 The Promoter can store the chosen prize free of charge for 30 days after notifying the First Prize Winner, at the end of which time the First Prize will be delivered to the Winner.
16. Winners' Personal Data
16.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.2, unless prohibited by law.
16.2 By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a Winner.
17. Limits of Liability
17.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.
18. Electronic Communications
18.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.
18.2 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.
The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner.
In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants YC credit to enable them to replay equivalent tickets in a subsequent competition.
18.3 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.
The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. Competition coordinates may be checked at any time by accessing your account at www.yiannimizecomps.com
18.4 To enter any "Where's The Ball" or the "Ready Set Play" draw each month for free, you must first create an account and then send your name, address, date of birth, e-mail address and contact telephone number on a postcard to the Promoter. Free entries must be posted to: Yiannimize Competitions, No.5 The Heights, Weybridge, Surrey, KT13 0NY and must arrive by the Competition closing date. First or second- class postage must be paid. Postal Entries are limited to one Entry per person to each Competition, each entry is to be submitted individually by postcard. The Entrant must specify which Competition, or which "Ready Set Play" draw they wish to enter. For Competitions a random number/s will be allocated to each free entry by the Promoter. All free entries will be treated in the exact same way as a paid Entries. All free Entries will be processed daily.
19. Data Protection Notice
19.1 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable.
In order to process, record and use your personal data the Promoter may disclose it to
19.1.1 any credit card company whose name you give;
19.1.2 any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you;
19.1.3 any person to whom the Promoter proposes to transfer its business or any part of it;
19.1.4 comply with any legal or regulatory requirement of the Promoter in any country; and
19.1.5 prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
